Information Privacy (POPIA & GDPR)
Protection of Personal Information Act (POPI Act) – POPIA aims to regulate the protection and access of personal information. This POPIA was enacted by the South African Parliament in 2013 and commenced application in 2020. Non-compliance with the Act could expose the Responsible Party to a penalty of a fine and/or imprisonment.
The General Data Protection Regulation (GRPR) – is a Regulation in the EU law on data protection and privacy in the EU and the European Economic Area. The GDPR is an important component of EU privacy law and of human rights law, in particular Article 8 of the Charter of Fundamental Rights of the European Union.
Personal Information means any information relating to an identifiable, living natural person or juristic person (companies, CC’s) and includes, but is not limited to:

- Demographic information: age, sex, race, birth date, ethnicity
- History relating to employment, financial, educational, criminal and medical details
- Biometric information: blood type
- Opinions of and about the person
